Ashok Arora Vs. SCBA case: Delhi High Court transfers suit challenging his removal from the post of SCBA Secretary to another bench

 

 

New Delhi, November 25, 2020: The Senior Advocate Arvind Nigam appearing for the Supreme Court Bar Association (SCBA) before the Delhi High Court argued that Ashok Arora's suit challenging his removal from the post of SCBA Secretary was becoming "luxury litigation" here today.

 

The Delhi High Court Justice Mukta Gupta ordered for the suit, along with Arora's application, to be placed before another bench subject to the order of the Chief Justice.

 

This response came soon after Arora urged Justice Mukta Gupta to transfer the suit to another bench, on the ground that she has already formed a prima facie opinion on the issue."If you want the transfer, I'll do it", Justice Mukta Gupta replied to Arora's request.

 

Following Arora's call for an Emergent General Meeting to remove Senior Advocate Dushyant Dave from the post of SCBA President, the Executive Council of the Association had suspended Arora from the post of Secretary with immediate effect.

 

Justice Mukta Gupta had held that Arora had not made out any prima facie case in his favour for grant of an injunction.The order was subsequently upheld by a Division Bench of the High Court after Arora preferred an appeal.
